Purpose

This permanent visa lets the spouse or de facto partner of an Australian citizen, Australian permanent resident or eligible New Zealand citizen live in Australia permanently.

It is usually granted to people who hold a temporary Partner (Provisional) visa (subclass 309).

Eligibility

You must:

• Hold a Partner (Provisional) visa (subclass 309) or Dependent Child visa (subclass 445).
• Usually wait until two years after applying for the combined subclass 309 and 100 visas.
• Continue to be the spouse or de facto partner of the same sponsor.
• Meet health requirements, including for relevant family members.
• Repay or arrange repayment of Australian Government debts.
• Meet the best-interests-of-the-child requirement for applicants under 18.

You may be granted the permanent visa in less than two years if:

• You were in a long-term partner relationship when applying; or
• Your sponsor holds, or held, a permanent humanitarian visa and the specified relationship requirements are met.

You may still be eligible if the relationship ends, your partner dies, or you experience domestic and family violence.

Stay and Rights

The visa is permanent. You become an Australian permanent resident on the grant date.

With this visa, you can:

• Live, work and study in Australia indefinitely.
• Access Medicare.
• Travel to and from Australia for five years.
• Sponsor eligible family members.
• Attend free Adult Migrant English Program classes, if eligible.
• Apply for Australian citizenship, if eligible.

Certain Australian Government payments and benefits may have waiting periods for newly arrived residents.

Travel

You may travel in and out of Australia as many times as you want for five years from visa grant, while the travel facility remains valid.

After the initial five-year travel facility, you must obtain a Resident Return visa (RRV) to return as a permanent resident.

If outside Australia when granted the visa, enter before the “first entry, arrive by” date in your grant letter.

New Zealand Passport Holders

Tell the border officer that you hold a permanent Australian visa and do not want a Special Category visa (subclass 444). A subclass 444 visa may override the permanent visa and affect citizenship eligibility.

Family Provisions

You can include family-unit members when applying for the temporary subclass 309 visa, provided they are outside Australia.

After grant of the subclass 309 visa, a dependent child can be added before the subclass 100 decision only if they:

• Hold a Dependent Child visa (subclass 445).
• Are a member of the family unit.
• Meet health requirements.
• Meet character requirements if aged 16 or older.

Attach Form 1002 – Application by a subclass 445 dependent child for a permanent partner visa in ImmiAccount, then notify the Department through the Partner Processing Enquiry Form.

You cannot add family members after grant of the subclass 100 visa.

Tell the Department if you have a baby after applying.

Cost and Processing

The visa charge was paid when you applied for the temporary and permanent Partner visas.

You may need to pay for health examinations or police checks.

Processing for the permanent stage starts from your eligibility date—usually two years after the combined application was lodged. Processing times vary, and complex cases may take longer.

Processing may be delayed if:

• The application is incomplete or incorrect.
• Required documents are missing.
• Further information is needed.
• Information requires verification.

Required Evidence

Submit documents only after two years have passed since the original combined application, unless the permanent visa was granted immediately.

Identity

Provide a copy of your current passport pages showing:

• Photograph and personal details.
• Signature.
• Issue and expiry dates.

Character

You may need:

• A current complete-disclosure Australian Federal Police National Police Certificate.
• Overseas police certificates for each country where you spent 12 months or more since grant of the subclass 309 visa.

Australian police certificates are valid for immigration purposes for 12 months from issue.

Relationship Evidence

Provide evidence that the relationship with the same sponsor is genuine and ongoing, including:

• A Commonwealth statutory declaration completed by the sponsor.
• Marriage certificate or evidence the marriage is valid in Australia, if married.
• Evidence of the de facto relationship, if applicable.
• Evidence of shared finances, household, social life and long-term commitment.
• Statements from two witnesses aged 18 or over using Form 888.

Examples include joint financial accounts, leases, bills, shared child-care responsibilities, travel evidence, joint activities, correspondence while apart and wills.

For each family member holding a subclass 309 or 445 visa, provide passport copies, relevant changed-circumstances documents and police certificates where required.

Document Preparation

• Translate non-English documents into English.
• Provide both original and translated documents.
• Scan or photograph documents in colour.
• Ensure scans are clear and complete.
• Save multi-page documents as one file.
• Certification is not required.

How to Apply

1. Wait until two years have passed since the original combined application.
2. Log in to ImmiAccount.
3. Select New application.
4. Select Family.
5. Select Stage 2 – Permanent Pattner Visa Assessment.
6. Attach required documents.

Attach each document only once and label documents clearly. You can attach up to 100 documents for each person on the application; this limit cannot be increased.

After Applying

Use ImmiAccount to track the application and attach further information.

Regularly update relationship evidence during processing. Tell the Department about:

• Changes to marital or de facto status.
• Birth of a child.
• New contact details, address or passport.
• Other relevant changes.
• Application withdrawal.
• Mistakes in the application.

If the relationship ends, you may need to complete the Notification of Relationship Cessation form in ImmiAccount.

Keep your ImmiAccount and email passwords secure. Do not share account access.

Obligations

You and your family members must comply with visa conditions and Australian laws.

If the visa is granted, keep the written decision, which states your visa grant number, start date and conditions.

Australian visas are digital. No visa label is placed in your passport.

Use VEVO to check visa details, conditions and travel-facility expiry. Your visa grant letter contains the visa number needed to access the digital visa record.
