Purpose

The Prospective Marriage visa lets you come to Australia to marry your prospective spouse. After marriage, you may apply for a Partner visa (subclasses 820 and 801) before this visa expires.

This is a temporary visa.

Eligibility

You must:

• Be outside Australia when applying. Any family members applying with you must also be outside Australia.
• Be aged 18 or over when applying.
• Have an approved sponsor who is your prospective spouse.
• Intend to marry your prospective spouse before the visa expires.
• Have met your prospective spouse in person as adults since turning 18.
• Be personally known to each other when you apply.
• Be in a relationship with an Australian citizen, Australian permanent resident, or eligible New Zealand citizen.
• Meet health and character requirements.
• Have repaid, or arranged repayment of, any Australian Government debt.
• Sign an Australian Values Statement if aged 18 or over.
• Not have immigration history that prevents eligibility, including certain visa cancellations or refusals.

Your relationship may be with a person of the same or different sex.

The Department may refuse the visa if granting it is not in the best interests of an applicant under 18.

Stay and Marriage Requirement

You can stay for 9 to 15 months from the visa grant date. Check your grant letter or VEVO for the expiry date.

You must:

• Enter Australia before the first-entry date in your grant letter, if outside Australia at grant.
• Marry your prospective spouse before the visa expires.
• Ensure the marriage is valid under Australian law.

You may marry in any country.

Cost

The main applicant charge is AUD11,710. Fees also apply for each family member included in the application.

You may also need to pay for:

• Health examinations
• Police certificates
• Biometrics
• A later Partner visa application

The application cannot be processed until the correct visa application charge is paid. The charge is not refunded if the application is refused.

Pacific Island and Timor-Leste concession

From 1 July 2026, a lower application charge applies to eligible applicants who hold a valid passport from:

• Federated States of Micronesia
• Fiji
• Kiribati
• Nauru
• Palau
• Papua New Guinea
• Republic of the Marshall Islands
• Samoa
• Solomon Islands
• Timor-Leste
• Tonga
• Tuvalu
• Vanuatu

Eligible family members receive the lower charge based on the primary applicant's passport.

Rights

Work

You have full work rights and Australian workplace-law protections.

Study

You may study in Australia. You will not receive government support, and study costs are your responsibility.

Travel

You may travel to and from Australia as many times as you wish while the visa remains valid.

If your first-entry date has expired but your visa remains valid, you can still travel to Australia. However, the visa may be cancelled before arrival or at the border.

Healthcare

The Department recommends health insurance. Without insurance, you may be personally liable for healthcare costs.

Some countries have reciprocal healthcare arrangements with Australia.

Family Members

You may include members of your family unit when lodging the application.

Before a decision is made, you may add a dependent child who is outside Australia using Form 1436.

Family members applying with you must:

• Be members of the family unit.
• Meet health requirements.
• Meet character requirements.
• Be outside Australia.

Family members aged 16 or over must meet character requirements. The Department may also require health or character information for non-migrating family members.

After the subclass 300 visa is granted, you cannot add family members to the visa.

Dependent children

A child aged 18 to 23 must be dependent on you or your partner. A child aged over 23 must be unable to support themselves because of physical or cognitive limitations and be dependent on you or your partner.

For a child under 18, obtain migration consent from any person with legal authority over where the child lives who is not travelling with the child. Use Form 1229, unless you provide an applicable court order or evidence that the home-country law permits permanent departure.

Required Evidence

Provide clear colour scans or photographs of original documents and English translations. Documents do not need certification.

Identity

Provide:

• Birth certificate showing both parents’ names, or accepted alternative identity evidence.
• Current passport identity pages.
• National identity card, if held.
• Name-change documents, if applicable.

Relationship

Provide evidence of:

• Your relationship with your prospective spouse.
• Meeting face-to-face as adults.
• Intention to marry within nine months of visa grant.
• Genuine intention to live together as spouses.
• Relationship history and future plans.
• Former relationships, where applicable.
• Dependants, where applicable.

Provide statements from two witnesses aged 18 or over who know both partners and the relationship. Witnesses can use Form 888. If a witness is an Australian citizen or permanent resident, provide evidence of that status.

Health and character

You must complete health examinations when required.

Provide:

• Form 80 for character assessment.
• An Australian Federal Police complete disclosure National Police Certificate if you spent 12 months or more in Australia during the past 10 years since turning 16.
• Police certificates for each country where you spent 12 months or more in the past 10 years since turning 16.
• Military service or discharge records, if applicable.

Police certificates and health examination results are generally valid for 12 months. The Department may request updated evidence if documents expire before a decision.

How to Apply

Apply online through ImmiAccount while outside Australia.

1. Create or log into ImmiAccount.
2. Select New application.
3. Select Family.
4. Select Stage 1 – Partner or Prospective Marriage Visa.
5. Attach supporting documents.
6. Pay the application charge.
7. Record the Transaction Reference Number (TRN).
8. Give the TRN or application ID to your sponsor.

Your sponsor should apply for sponsorship as soon as possible after you apply.

You may attach up to 100 documents per person. Clearly label documents and attach each document only once.

Conditions and Obligations

You and any family members must:

• Obey Australian laws.
• Meet all visa conditions.
• Keep a valid visa while in Australia.
• Tell the Department about relevant changes.
• Notify the Department of a child’s birth or other material change.
• Notify the Department if the relationship ends.

Use VEVO to check visa conditions and validity.

Important Warnings

• Do not arrange travel until you receive written confirmation that the visa has been granted.
• If you marry before a decision, you are no longer eligible for this visa. You must notify the Department, provide a valid marriage certificate, request consideration for a Partner visa (subclasses 309 and 100), and withdraw the subclass 300 application. Otherwise, it will be refused.
• If you obtain another visa, it replaces the subclass 300 visa. This may affect the lower Partner visa charge available to subclass 300 holders.
• New Zealand passport holders should tell border officers they hold a subclass 300 visa and do not want a Special Category visa (subclass 444), as a subclass 444 grant overrides the subclass 300 visa.
• Forced marriage is a crime in Australia.
