Purpose & Overview

The Prince Edward Island (PEI) Office of Immigration administers provincial immigration pathways to address local labour market shortages. Allocations are set annually by the federal government. Candidates nominated by PEI can apply for Canadian permanent residency through Immigration, Refugees and Citizenship Canada (IRCC).

Immigration pathways include:

• PEI Express Entry: Federal Skilled Worker, Federal Skilled Trades, and Canadian Experience Class.

Stream Eligibility Criteria

All applicants must be 18 to 59 years of age, possess sufficient financial resources to pay immigration and travel costs to establish in PEI, and demonstrate a genuine intention to settle in Prince Edward Island.

1. Skilled Worker Stream

• Job Offer: Full-time, non-seasonal (permanent or minimum 2-year contract) in TEER category 0, 1, 2, or 3.
• Work Experience: Minimum 2 years of full-time work experience in the past 5 years.
• Education: Post-secondary degree or diploma (minimum 2-year program).
• Status: Valid Canadian work permit and legal status in country of residence.
• Language: Minimum CLB/NCLC 4 test score (valid within 2 years) or an employer-signed PEIW-02: Workforce Job Offer Form confirming language proficiency.
• Recruitment Outside Canada: Permitted if the PEI employer receives authorization from the Office of Immigration before issuing the job offer.

2. Critical Worker Stream

6. PEI Express Entry

• Requirement: Valid Federal Express Entry profile under FSWP, FSTP, or CEC.
• Condition for Out-of-Province Graduates / Spouses: Must have 9 months of continuous work experience with the supporting PEI employer and at least 4 months remaining on the work permit at EOI submission if holding an out-of-province PGWP or spousal open work permit tied to an out-of-province study permit.

General Ineligibility (All Streams)

Applicants are ineligible if they:

• Have an active application with PEI or another Canadian province/territory.
• Were previously refused for misrepresentation in any immigration program.
• Reside or work in Canada unlawfully, or failed to apply for restoration within 90 days of losing status.
• Are unresolved or failed refugee/humanitarian claimants in Canada.
• Hold a job offer that is seasonal, part-time, casual, 100% commission-based, or not located in PEI.
• Are self-employed, business shareholders, or intend to start a business in PEI.
• Hold a job permanently based from a home/virtual office that does not meet the Telework Policy.

Employer Requirements

Supporting employers must:

• Operate continuously in PEI under current management/ownership for at least 2 years.
• Prove unsuccessful domestic recruitment efforts for the position within Canada.
• Offer full-time, non-seasonal employment meeting provincial wage standards and labour laws.
• Submit the completed PEIW-02: Workforce Job Offer Form.
• Register with the Federal Employer Portal and pay the $230 Employer Compliance Fee (LMIA exemption code T13 under R204(c)) if a work permit support letter is required.

Special Employer Policies

• Trucking Sector (NOC 73300): Must have an established physical business place in PEI (street address, signage, equipment storage/garage), operate for 24+ months under the same ownership, and demonstrate a direct employer-employee relationship (temporary placement agencies are not permitted).
• Telework Policy: Purely virtual businesses are ineligible. For hybrid/telework roles, the applicant must live in PEI; teleworking PNP/AIP applicants cannot exceed 25% of the employer's total workforce; and the business must have operated from a commercial space in PEI with at least 10 local resident employees for 2+ years (unless supported by Innovation PEI).

Application Steps & Fees

1. Assess Eligibility: Verify stream requirements and employer eligibility.
2. Submit Expression of Interest (EOI): Complete a profile in the PEI online system.
3. Receive Invitation to Apply (ITA): Invitations are issued based on provincial priorities, allocation limits, and score.
4. Submit Provincial Application:
   • Submit online within the specified timeframe.
   • Pay the non-refundable $300 CAD provincial processing fee.

Important Warnings & Obligations
