Purpose and Overview

The Representative of an Overseas Business visa is for employees of overseas newspapers, news agencies, or broadcasting organisations posted on a long-term assignment to the UK.

Note: Businesses planning to establish their first UK branch must apply for the UK Expansion Worker visa (Global Business Mobility). Individuals already in the UK as sole representatives may still apply to extend their stay.

Eligibility Requirements

To qualify, you must:

  • Be an employee of an overseas newspaper, news agency, or broadcasting organisation posted to the UK on a long-term assignment.
  • Have enough money to support yourself and any dependants without public funds.
  • Meet the English language requirement.

English Language Requirement

You must prove English ability to at least CEFR level A1 in speaking and listening through one of the following:

Exempt Nationalities: Nationals of Antigua and Barbuda, Australia, the Bahamas, Barbados, Belize, British overseas territories, Canada, Dominica, Grenada, Guyana, Jamaica, New Zealand, St Kitts and Nevis, St Lucia, St Vincent and the Grenadines, Trinidad and Tobago, and the USA do not need to prove English language proficiency.

Length of Stay and Settlement

  • Initial Stay: 3 years.
  • Extension: Up to 2 years (or 3 years if your original visa was issued before 1 October 2009).
  • Permanent Settlement (Indefinite Leave to Remain): You can apply to settle permanently after 5 continuous years in the UK while remaining employed with the same organization.

Permitted and Prohibited Activities

You Can:

  • Work full-time for your overseas employer.
  • Bring eligible family members (dependants).

You Cannot:

  • Access public funds (state benefits).

Family Provisions (Dependants)

Extending the Visa

You must apply online from inside the UK before your current permission expires.

Extension Criteria:

  • You still work for the same employer.
  • The employer’s principal place of business remains outside the UK.
  • Sole Representatives: You must still supervise the UK branch or subsidiary established for the business.

Required Extension Documents:

  • Media Employees: Letter from employer confirming continuation in the role and salary details.
  • Sole Representatives: Employer confirmation letter, salary details, business activity description (accounts, invoices, client letters), Companies House registration/incorporation certificate, and evidence the UK entity is wholly owned by the overseas business.

Switching to This Visa

You can apply to switch inside the UK if you are an employee of an overseas media organisation on a long-term assignment.

  • Students: Permitted to switch only if you completed your course or completed at least 24 months of full-time PhD study.
  • Ineligible to Switch: Sole representatives, or individuals currently holding a visit visa, short-term student visa, Parent of a Child Student visa, seasonal worker visa, domestic worker visa, immigration bail, or leave outside the immigration rules.

Important Warnings

  • Travel Restrictions During Processing: If applying to extend or switch from inside the UK, you must not travel outside the Common Travel Area (UK, Ireland, Channel Islands, Isle of Man) until you receive a decision. Travelling abroad will automatically withdraw your application.
