Purpose

This visa is for a child in New Zealand who is a suspected victim of people trafficking and has been certified by New Zealand Police. It allows the child to study as a domestic student at primary or secondary school.

Eligibility

The child must:

• Be in New Zealand.
• Have been aged 17 or younger when identified as a victim of people trafficking.
• Be certified by New Zealand Police as a victim of people trafficking.
• Have had a people trafficking report assessed by New Zealand Police.
• Be in good health and of good character.
• Genuinely intend to meet the visa conditions.

The child may be unaccompanied or may be a trafficking victim together with their parents.

Study and Work Rights

Study

School-aged children may study at a primary or secondary school in New Zealand.

Work

Work rights may be granted only if the child is aged 16 or 17 and has permission from:

• Their parent or guardian; and
• Their school.

If granted, work is limited to:

• Up to 25 hours each week during study periods.
• Full-time during scheduled holidays, including Christmas and New Year holidays.

Children under 16 are not granted work rights.

The child must not be self-employed. They must work as an employee under an employment agreement, not as an independent contractor.

Anyone working in New Zealand must pay tax. An IRD number can be applied for through Inland Revenue.

Evidence and Documents

Identity

Provide:

• Two acceptable photos of the child.
• The child's passport or certificate of identity.

If unavailable, provide the original or certified copy of a birth certificate or another identity document.

Police certification

Provide evidence that New Zealand Police has certified the child as a victim of people trafficking. Immigration New Zealand will check this certification.

Health

The child may need a chest X-ray and medical examination.

Applicants from China, Hong Kong or Macao applying within those locations must provide a chest X-ray completed within the last 3 months if the child:

• Spent 6 consecutive months in China since the last X-ray; and
• Is coming to New Zealand for more than 6 months.

Character

Children aged 17 or older may need to provide police certificates.
